1.1. This Privacy Statement applies to FiscalNote, Inc. (with registered offices at 1201 Pennsylvania Avenue NW, 6th Fl. Washington D.C. 20004). (“FiscalNote,” “our”, “we” and “us”). FiscalNote (“we”) is a global technology and media company that provides policy data, news, analytics, and workflow tools to help organizations assess and act on risk and opportunity. FiscalNote is a separate and independent legal entity that processes personal data. We act as data controller for the processing of your personal data. During the course of our business, we can also act as a data processor when we process data on behalf of a customer.

1.2. We are committed to protect and process personal data entrusted to us in a correct and transparent manner, in particular in accordance with the applicable legislation and, in particular, the General Data Protection Regulation 2016/679 of 27 April 2016 (“GDPR”) and the California Consumer Privacy Act (“CCPA”).

2.1. This Privacy Statement informs you about how and why we process your personal data as a data controller when we perform our activities or when you use the Site and any of the forms and applications offered thereon, who we give that information to, what your rights are and who you can contact for more information.

2.2. When we refer to “the Site”, we mean the webpages that start with the following url: https://fiscalnote.com/.

2.3. The Sites may contain links to other websites. While we try to link only to websites that share our high standards regarding data protection, we are not responsible for the content or policy regarding data protection of those websites. This Privacy Statement only relates to data collected by us. When linking to the Sites, we strongly recommend you to first review the Privacy Statements on these websites, before disclosing any personal information. Please be aware that, when you visit our page on Facebook, Instagram, LinkedIn or Twitter whether or not using the shortcut on our website, cookies are used by Facebook and Instagram. In this way, we can obtain more information - in a complete anonymised way - about the public that visits our Facebook, Instagram, LinkedIn and Twitter pages.

2.4 As a licensed user with respect to FiscalNote Services, you may receive requests from time to time to participate in market research, including but not limited to certain polls and surveys which may be submitted by independent third parties retained by FiscalNote for market research. Any personal data collected by a third party will be subject to privacy policy of that third party.

3. For what purposes do We process personal data?

We process your personal data for legitimate business reasons. These purposes include, but are not limited to:

  • the good organisation of our services;
  • direct marketing and sales;
  • marketing purposes;

4. on what legal grounds do We process your personal data?

4.1. I AM A WEBSITE VISITOR

4.1.1. When you contact us via a general contact address or via an online contact form (e.g. for requesting a demo) your personal data will in principle be processed for the purposes of our legitimate interests (namely the interest to handle your enquiries, requests and customers in the best possible way). In this respect we will always determine case by case whether our interests outweigh your interests, fundamental rights and freedoms. If you want more information about this, you can always contact us via privacy@fiscalnote.com.

4.1.2. For sending electronic direct marketing, we will always ask your explicit consent, unless we have obtained your e-mail address in the context of the sale of related products or services and you have not opposed to such use of your data. You may unsubscribe at any time by clicking ‘Unsubscribe’ at the bottom of the direct marketing message.

4.2. I AM A EUROPEAN PUBLIC OFFICIAL 

In the context of the EU Issue Tracker platform, we will process your personal data because it is necessary for the purposes of our legitimate interests, more specifically the good organisation of our services by providing our clients with an accurate and up to date platform. Before relying on legitimate interests, we always assess whether our interests are not overridden by your interests, fundamental rights and freedoms. For the processing of your personal data, we have conducted a so-called "Legitimate Interests Assessment" (LIA) and we have concluded that legitimate interests is an appropriate basis for processing. Upon request, you can obtain more information on the LIA and its outcome.

4.3. I AM (A CONTACT PERSON OF) A CUSTOMER, A SUPPLIER OR ANY OTHER INDIVIDUAL WHOSE PERSONAL DATA ARE PROCESSED (E.G. A VISITOR, A BUSINESS CONTACT OR A CONSUMER)

4.3.1 We process your personal data on the following legal grounds: - for the purpose of concluding and performing contracts concluded with you, including (but not limited to) accounting, invoicing and deliveries; - for complying with legal obligations; - for the purpose of the legitimate interests of our company and/or a third party, including (but not limited to) the smooth running of our business activities, customer and supplier management etc. and after conducting a balancing test. 4.3.2 If we have the legal obligation to obtain your free, informed, specific and unambiguous consent to process your personal data for certain purposes (e.g. very specific direct marketing and market research activities), we will only process your data for such purposes to the extent that we have obtained such consent from you. For example, we will always ask your explicit consent for sending direct marketing, unless we have obtained your e-mail address in the context of the sale of related FiscalNote family products or services and you have not opposed to such use of your data. You may unsubscribe at any time by clicking unsubscribe at the bottom of the direct marketing message.

5. WHAT ARE YOUR RIGHTS?

5.1. You have several rights concerning the personal data that we process about you. In particular, you have the right to: 

  • gain access to your personal data and receive a copy thereof; 
  • ask that we update or correct your personal data when you believe they are incorrect or incomplete; 
  • ask that we delete your personal data, or restrict the way in which we use such personal data when you believe that we no longer have a lawful ground to process it; 
  • withdraw consent to the processing of your personal data (to the extent such processing is based on your consent); 
  • receive your personal data in a structured, commonly used and machine-readable format and to transfer such data to another party (to the extent the processing is based on consent or on the execution of a contract); 
  • object to the processing of your personal data for which we use legitimate interest as a legal ground, in which case we will cease the processing unless we have compelling legitimate grounds for the processing.

5.2. You also have the right to object at any time to the processing of personal data for direct marketing by contacting us (see below) or by clicking the unsubscribe link in the direct marketing messages we sent. In that case, we will no longer process your personal data for direct marketing purposes.

5.3. In order to exercise any of the abovementioned rights, you can:

  • send a written query to: 1201 Pennsylvania Avenue NW, 6th Fl. Washington D.C. 20004 to the attention of the Legal Department Compliance Manager. You may also use these contact details if you wish to make a complaint relating to the processing of personal data.

5.4. If you are unhappy with the way we handle your personal data, you have the right to complaint to the relevant state authority in which you reside.


6. HOW DO WE OBTAIN PERSONAL DATA?

6.1. I AM A WEBSITE VISITOR

We may obtain your personal data when you use the Sites and the applications offered thereon (e.g. contact form, demo request form). We may also obtain your data when you contact us via the contact details mentioned on the Sites.

6.2 I AM A EUROPEAN PUBLIC OFFICIAL

In order to provide our services, we collect and process personal data of European public officials from publicly-available sources (e.g. the EU Parliament website, government websites, a public official's individual website etc.). It concerns both Members of the European Parliament (MEPs) and national legislators (i.e. French, German, Russian, Swiss, Ukrainian or UK legislators).

This information is used on our platform which can be used by our customers to gain understanding of legislation, regulations and their status, as well as the methods for contacting public officials.

6.3 I AM (A CONTACT PERSON OF) A CUSTOMER, A SUPPLIER OR ANY OTHER INDIVIDUAL WHOSE PERSONAL DATA ARE PROCESSED (E.G. A VISITOR, A BUSINESS CONTACT OR A CONSUMER)

6.3.1 We may obtain your personal data in the framework of the execution of our business activities.

6.3.2 We may obtain such personal data because you give it to us (e.g. by contacting us), because others give it to us (e.g. third party service providers that we use in the framework of our activities) or because they are publicly available. We may also obtain your personal data through the way you interact with us.

6.3.3 When we obtain your personal data from external parties, we make reasonable efforts to enter into contractual clauses with these parties obliging them to respect the relevant data protection legislation. This can for example be done by obliging this party to provide you with all necessary information or - if necessary - to obtain your consent for processing the personal data as described in this Privacy Statement.

 

7. WHICH PERSONAL DATA DO WE COLLECT?

7.1. I AM A WEBSITE VISITOR

7.1.1. We may collect all your personal data that you yourself provide to us when you contact us via the contact details mentioned on the Site or when you us the applications on the Site.

7.1.2. In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services. We use this information to provide you with information about our products and services and to contact you about important updates to our Services. Furthermore, we may use the Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system and other visitor details collected in our log files to analyze the trends, administer the website, track visitor’s movements and to improve our website.

The following categories of personal data are processed in the context of the FiscalNote platform "EU Issue Tracker" and associated products and services: 

  • Information processed from Members of the European Parliament: name, EU Party, nationality, national party, date of birth, place of birth, Brussels office address, Strasbourg office address, postal address, email, phone number, fax number, website, Facebook address, Twitter address, Committees and delegations, role and domain of work;
  • Information processed from national legislators (e.g., French, German, Russian, Swiss, Ukrainian or UK legislators): country, party, chamber, district, sessions in Office, Twitter, website, Facebook;
  • Information processed from members of the European Commission: title, name, role, postal address, email, professional phone number, fax number, website, Facebook address, Twitter address, domain of work; 
  • Information processed from Council of the European Union: title, name, role, postal address, email, professional phone number, fax number, website, Facebook address, Twitter address, domain of work; 
  • Member State Permanent Representatives: title, name, role, postal address, email, professional phone number, fax number website, Facebook address, Twitter address, domain of work The platform does not contain supplementary information beyond what is listed;
  • Information regarding persons' political positions or viewpoints on matters.

7.3. I AM (A CONTACT PERSON OF) A CUSTOMER, A SUPPLIER OR ANY OTHER INDIVIDUAL WHOSE PERSONAL DATA ARE PROCESSED (E.G. A VISITOR, A BUSINESS CONTACT OR A CONSUMER)

7.3.1. The personal data that we collect may include the following:

  • standard identification and contact data (e.g., name, address (private/work), telephone number (private/work), e-mail address (private/work);
  • personal characteristics (e.g., age, gender, date of birth, place of birth, nationality, language);
  • financial data (e.g. bank account number); - employment data (e.g. organization you work for, job title);
  • the information you provide us in forms (e.g. contact forms) and to all possible services and communication channels that we offer;
  • data about how you use our products and services;
  • information about delivered products and/or services;
  • data about how you interact with us and other similar information.

 

8. TO WHOM CAN WE DISCLOSE YOUR PERSONAL DATA?

8.1. I AM A WEBSITE VISITOR OR I AM (A CONTACT PERSON OF) A CUSTOMER, A SUPPLIER OR ANY OTHER INDIVIDUAL WHOSE PERSONAL DATA ARE PROCESSED (E.G. A VISITOR, A BUSINESS CONTACT OR A CONSUMER)

We may disclose your personal data to affiliated companies or third parties who reasonably require access to such data in order to fulfill one or more of the abovementioned purposes. The following external parties may for instance be involved:

  • external service providers the Company relies on for various business services;
  • law enforcement authorities and public authorities in accordance with the relevant legislation;
  • external professional advisors (e.g. attorneys or consultants of the Company) With your explicit opt-in consent, we may transfer personal data to third parties (e.g. marketeers) for direct marketing purposes, including targeted advertising.

8.2. I AM A EUROPEAN PUBLIC OFFICIAL

We may disclose your personal data to affiliated companies, third parties that provide services to us that reasonably require access to personal data relating to you for one or more of the purposes mentioned above.

The users of the FiscalNote platform “EU Issue Tracker” will have access to your personal data too. These users have committed themselves:

  • to use the platform only for purposes that are permitted by (a) the Terms of Service Agreement and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
  • not to access (or attempt to access) the platform by any means other than through the interface provided by FiscalNote, unless they are specifically allowed to do so in a separate agreement;
  • not to engage in any activity that interferes with or disrupts the platform (or the servers and networks connected to the platform);
  • not to reproduce, duplicate, copy, sell, trade or resell the information on the platform for any purpose, unless they are specifically allowed to do so in a separate agreement.

We also reserve the right to disclose your personal information as required by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on us.


8.3. Your personal data may be transferred from our subsidiaries in the European Economic Area to the United States in order to provide our Services. We have adopted Standard Contractual Clauses approved by the European Commission (art. 46 GDPR) as appropriate safeguard as well as additional security measures to ensure compliance with data protection requirements. 9. What cookies do We use and how can you manage them?

We may use session and/or persistent cookies with respect to the FiscalNote Services. We may, from time to time, retain an independent third party to perform an analysis of the statistical and aggregate data and other information with respect to our Services. Such aggregated information is not personally identifiable and is used to improve the functionality and/or use of our Services and future product offerings. Such third parties may, at their option, employ the use of cookies in the provision of their third-party services. FiscalNote does not have access to these third-party cookies nor are we responsible for them. For more information about our use of cookies, please see our “Cookie Policy.”

 

10. ARE YOUR PERSONAL DATA PROTECTED?

10.1. We employ strict technical and organizational (security) measures to protect your personal data from access by unauthorized persons, against unlawful processing, misuse, damage, loss and destruction both online and offline.

10.2. These measures include for example: 

  • Training to relevant staff to ensure they are aware of our privacy obligations when handling personal data and disciplinary action in the event of non-compliance;
  • Immediate deletion of data if not relevant anymore (e.g. because the information is outdated); 
  • Termination or suspension of the access to or license of the platform in case of a violation of the FiscalNote Terms of Service Agreement and/or the Security Policy;
  • Password protection and access control by appropriate FiscalNote personnel; 
  • Network security and intrusion detection systems to protect the platform against sophisticated attacked and to minimize vulnerabilities;
  • Cloud computing infrastructure which provides redundancy and high availability at every level, from multiple Tier- ISP connections, redundant networking equipment and servers;
  • Hosting of the platform in secure SOC 2 Type II certified facilities that are protected from physical attacks and from natural disasters. The data centers are monitored on a 7x24 basis and entrance to the data centers is controlled and restricted to a select group of authorized personnel. Multiple forms of authentication must be used in order to enter any such data centers;
  • Security incident management; 
  • Recovery, contingency and emergency plan.

10.3. In a cloud computing environment, certain computer resources may at some point fail to operate – FiscalNote has designed its infrastructure in light of that potential failure. The core cloud computing infrastructure provides redundancy and high availability at every level, from multiple Tier-1 ISP connections, redundant networking equipment, and servers. FiscalNote’s Services are built on this infrastructure with the ability to quickly add or change service capacity in response to customer load or in an uncommon situation where a compute infrastructure experiences a failure. FiscalNote monitors each of its Services critical performance metrics to track availability and performance. FiscalNote periodically backs up appropriate data across multiple servers so as to protect that same data in the event of a service failure.

10.4. FiscalNote Services are hosted in secure, SOC 2 Type II certified facilities that are protected from physical attacks and from natural disasters. Such data centers are monitored on a 7×24 basis and entrance to the data centers is controlled and restricted to a select group of authorized personnel. Multiple forms of authentication must be used in order to enter any such datacenter and the data centers are guarded and protected 7 days a week, 24 hours a day.

10.5. Although we use appropriate security measures once we have received your personal data, the transmission of data, especially over the internet (including by e-mail), is never completely secure. We endeavor to protect your personal data, but we cannot guarantee the security of data transferred to us or by us. We limit access to your personal data to persons who reasonably need that information in order to carry out their jobs.

11. HOW LONG WILL YOUR PERSONAL DATA BE STORED?

11.1. I AM A WEBSITE VISITOR

11.1.1. Your personal data will not be stored longer than necessary for the abovementioned purposes.

11.1.2. As a general rule, personal data obtained through the Site are stored for a period of 5 years. Personal data processed in the context of direct marketing, for example for our newsletters, will in principle be stored for a period of 5 years from the last contact with our company. However, we can store your personal data longer for these purposes if in the meantime you have become our customer, namely for a period of 10 years from the delivery of products or services, or from the last contact with our company if that would take place later.

11.1.3. Depending on the specific situation we may however retain your personal data for a longer period. This will in particular be the case if any of the following periods is longer: (i) as long as is necessary for the activity or service concerned; (ii) any retention period that is required by law; or (iii) the prescription period wherein litigations may be instituted.

11.2. I AM A EUROPEAN PUBLIC OFFICIAL

Your personal data will not be stored longer than necessary for the purposes mentioned above. As a general rule, your personal data will be deleted immediately if they are not relevant anymore for the platform.

11.3. I AM (A CONTACT PERSON OF) A CUSTOMER, A SUPPLIER OR ANY OTHER INDIVIDUAL WHOSE PERSONAL DATA ARE PROCESSED (E.G. A VISITOR, A BUSINESS CONTACT OR A CONSUMER)

11.3.1. As a general rule, personal data in the framework of the use of our services are stored for a period of 10 years as from the end of the contractual relationship (including warranty periods and after-sales services).

11.3.2. Personal data processed in the context of direct marketing, for example for our newsletters, will in principle be stored for a period of 5 years from the last contact with our company. However, we can store your personal data longer for these purposes if in the meantime you have become our customer, namely for a period of 10 years from the delivery of products or services, or from the last contact with our company if that would take place later.

11.3.3. Depending on the specific situation, we may however retain your personal data for a longer period. This will in particular be the case if any of the following periods is longer: (i) as long as is necessary for the activity or service concerned; (ii) any retention period that is required by law; or (iii) the prescription period wherein litigations may be instituted.

 

12. ARE YOUR PERSONAL DATA USED FOR AUTOMATED DECISION-MAKING?

12.1. Automated decisions are defined as decisions about individuals that are based solely on the automated processing of personal data, and that produce legal effects, and that significantly affect the individuals involved. As a rule, personal data will not be used for automated decision-making. We do not base any decision about you solely based on automated processing of personal data (also not in the context of our recruitment procedure).

 

13. Your responsibilities when using our service and our websites

When you use our Services, you agree to abide by certain rules of conduct, including the following:

You agree that any registration information you give to FiscalNote will always be accurate, correct and up to date.

You agree to use the Services only for purposes that are permitted by (a) the Terms of Service Agreement and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries).

You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by FiscalNote, unless you have been specifically allowed to do so in a separate agreement with FiscalNote. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.

You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).

Unless you have been specifically permitted to do so in a separate agreement with FiscalNote, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.

You agree that you are solely responsible for (and that FiscalNote has no responsibility to you or to any third party for) any breach of your obligations under the Terms of Service Agreement and for the consequences (including any loss or damage which FiscalNote may suffer) of any such breach.

 

14. Your passwords and account security

You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services.

Accordingly, you agree that you will be solely responsible to FiscalNote for all activities that occur under your account.

If you become aware of any unauthorized use of your password or of your account, you agree to notify FiscalNote immediately.

 

15. Children

Individuals under 18 are not eligible to use FiscalNote’s Services. Moreover, FiscalNote does not knowingly collect personal information from individuals under 18. If you are under 18, you should not use our service. If you become aware that we inadvertently hold or have access to personal data about anyone under 18, please let us know so we can delete it.

16. Forums / chat / blogs / directory

If you choose to use a bulletin board or directory, import a blog, or participate in a chat room, you should be aware that any personal data you choose to provide there can be read, collected and/or used by other parties and that such personally identifiable information could be used to send you unsolicited messages.

FiscalNote is not responsible for any personal data that you choose to submit with respect to these forums.

17. Anonymous data

FiscalNote may accumulate and aggregate certain anonymous statistical and related data in order to improve the performance and functionality of its Services, to develop new products and/or Services or to analyze the usage of FiscalNote’s Services.

FiscalNote may use aggregated anonymous data for such purposes as FiscalNote, in its sole discretion, deems to be appropriate.

18. Exclusion of warranties

Nothing in these terms shall exclude or limit FiscalNote’s warranty or liability for losses which may not be lawfully excluded or limited by applicable law. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages. Accordingly, only the limitations which are lawful in your jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law. You expressly understand and agree that your use of the services is at your sole risk and that the services are provided “as is” and “as available.” In particular, FiscalNote, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that: • your use of the services will meet your requirements,

  • your use of the services will be uninterrupted, timely, secure or free from error,
  • any information obtained by you as a result of your use of the services will be accurate or reliable, and
  • that defects in the operation or functionality of any software provided to you as part of the services will be corrected.

Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from FiscalNote or through or from the services shall create any warranty not expressly stated in the terms.

FiscalNote further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

19. Limitations of liability

19.1. You expressly understand and agree that FiscalNote, its subsidiaries and affiliates, and its licensors shall not be liable to you for:

  • any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by you, however caused and under any theory of liability. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss;
  • any loss or damage that may be incurred by you, including but not limited to loss or damage as a result of:
    • any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the services;
    • any changes which FiscalNote may make to the services, or for any permanent or temporary cessation in the provision of the services (or any features within the services);
    • the deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the services;
    • your failure to provide FiscalNote with accurate account information;
    • your failure to keep your password or account details secure and confidential;
    • your financial or business decisions based on the content provided.

19.2. The limitations on FiscalNote’s liability to you shall apply whether or not FiscalNote has been advised of or should have been aware of the possibility of any such losses arising.

EU-US Data Privacy Framework

A. POLICY APPLICATION AND ADHERENCE TO PRIVACY FRAMEWORK. FiscalNote, Inc. and its U.S. subsidiaries FiscalNote Boards, LLC; Predata, Inc.; Fireside 21 LLC; FactSquared, LLC; VoterVoice, L.L.C.; Sandhill Strategy, LLC; CQ-Roll Call, Inc.; Capitol Advantage LLC; The Oxford Analytica International Group LLC; Curate Solutions, Inc.; Frontier Strategy Group, LLC; Forge.AI, Inc.; and Dragonfly LLC (collectively “FiscalNote”) FiscalNote complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce. FiscalNote has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. B. DATA COLLECTION. In order to access certain services, you may be required to provide information about yourself. This information could include physical address, email address, IP addresses, phone number, name, and browser data.

C. PURPOSE FOR WHICH EACH TYPE OF DATA COLLECTED IS BEING USED. Our customers may provide information to us about their permissioned users, and for whom we maintain separate accounts on our Service. When they do so, we serve as a data processor for the information that they provide us on their behalf. Moreover, FiscalNote may process data and information from its customers for the purpose(s) of data storage, transformation, monitoring activity in our platforms to enhance the platform, data visualization, showing in-platform tours, page views, product interactions and in some instances email marketing to existing customers.

D. RIGHTS OF INDIVIDUALS. FiscalNote recognizes and acknowledges a right of access by EU and UK individuals. Pursuant to the Data Protection Framework Frameworks, EU and UK individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Data Protection Framework, should direct their query to privacy@fiscalnote.com. If requested to remove data, we will respond within a reasonable timeframe. In addition, a request for access is available to individuals whose personal data we are processing, and they can access, correct, or delete their personal data upon request. A request can be made by reaching out to the contact email privacy@fiscalnote.com.

E. LIMITING USE AND DISCLOSURE OF DATA. We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to privacy@fiscalnote.com and we will respond accordingly.

F. APPLICABLE THIRD-PARTY DISCLOSURE. FiscalNote may use the following third party data processors: (i) Salesforce; (ii) Snowflake (data storage); (iii) Databricks (data storage & transformation); (iv) Segment.io (tool that captures customer activity in our platforms); (v) Heap (tool that captures customer activity in our platforms); (vi) Looker (for data visualization, does not store data); (vii) Chameleon (receives customer activity in order to show in-platform tours); (viii) Churnzero (platform performance enhancement); (ix) DBT (tool used to build data models in Snowflake for operational analytics and data integrations); (x) Stitch (used to move data from source to data warehouse).

G. GOVERNMENT ACCESS. FiscalNote may be required to disclose an individual’s personal information in response to a lawful request made by a public authority figure, including but not limited to meeting national security or law enforcement requirements.

H. ONWARD TRANSFER. FiscalNote’s accountability for personal data that it receives in the United States under the Data Protection Framework and subsequently transfers to a third party is described in the Data Protection Framework Principles. In particular, FiscalNote remains responsible and liable under the Data Protection Framework Principles if the third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the principles, unless FiscalNote proves that it is not responsible for the event giving rise to the damage.

J. INDEPENDENT RECOURSE MECHANISM. In compliance with the EU-US Data Privacy Framework program’s Principles, FiscalNote commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union and United Kingdom individuals with DPF inquiries or complaints should first contact FiscalNote.

FiscalNote has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers for more information and to file a complaint. This service is provided free of charge to you.

If your complaint involves human resources data transferred to the United States from the European Union or the United Kingdom in the context of the employment relationship, and FiscalNote, Inc. does not address it
satisfactorily, FiscalNote, Inc. commits to cooperate with the panel established by the EU data protection authorities (DPA Panel) and the UK Information Commissioner’s Office, as applicable, and to comply with the advice given by
the DPA panel [ICO, as applicable] with regard to such human resources data. To pursue an unresolved human resources complaint, you should contact the state or national data protection or labor authority in the appropriate jurisdiction. Contact details for the EU data protection authorities can be found at https://edpb.europa.eu/about-edpb/board/members_en. Complaints related to human resources data should not be addressed to the Data Privacy Framework Services operated by BBB National Programs.

K. LAST-RESORT ARBITRATION. In compliance with the EU-US Data Privacy Framework program’s Principles, FiscalNote commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union and United Kingdom individuals with DPF inquiries or complaints should first contact FiscalNote at privacy@fiscalnote.com.

L. ENFORCEMENT. FiscalNote is subject to the investigatory and enforcement powers of the Federal Trade Commission and any other applicable U.S. authorized statutory body.

California Privacy Rights

Last Date of Revision: Jan 30, 2022.

1. The California Consumer Privacy Act (CCPA), effective January 1, 2020, gives California consumers enhanced rights with respect to their personal information that is collected by businesses. First, California consumers may opt out of having their personal information sold to other persons or parties. Second, they have a right to know:

  • What specific pieces of information a business has about the consumer;

  • Categories of personal information it has collected about the consumer;

  • Categories of sources from which the personal information is collected;

  • Categories of personal information that the business sold or disclosed for a business purpose about the consumer;

  • Categories of third parties to whom the personal information was sold or disclosed for a business purpose; and

  • The business or commercial purpose for collecting or selling personal information.

In addition, California consumers can request that the personal information a business has collected about them be deleted from the business’s systems and records. FiscalNote may be considered a covered business under the CCPA as it collects and processes the personal information of California consumers. This Privacy Policy provides the required notices to California consumers. The CCPA also prohibits covered businesses from providing discriminatory treatment to California consumers if they exercise their rights under the Act.

FiscalNote does not presently sell any personal information to third parties for any purpose.

To make a "request to know" or "request to delete" your personal information, send us an e-mail at privacy@FiscalNote.com (Please put either “Request to Know” or "Request to Delete" in the subject heading of your email.) You may also submit these requests via an online form (available at this link).

We will honor these requests for US individuals whether or not you are a California consumer under the CCPA. We will confirm receipt of your request within 10 days along with a description of what steps we will take to verify and respond. We must provide the requested information or delete your personal information within 45 days of receipt of your request. If necessary, we can take up to an additional 45 days, but we must let you know the additional time is needed.

When contacting us, we may ask you to provide certain, limited personal information, such as your name, email address and/or account login ID and/or password, to verify your request and to match with our records and systems. This is also to protect against fraud. We will not retain this personal information or use it for any other purpose. Also please be advised that we need to search our records and systems only for the preceding 12 months.

Residents of other states may also have similar rights to request information about or delete their personal information. To inquire about exercising these rights, please contact us at privacy@FiscalNote.com.

Pursuant to California’s "Shine The Light law" (California Civil Code § 1798.983), California residents are entitled, once a year and free of charge, to request the disclosure of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year, if any. Under the law, a business should either provide California customers certain information upon request or permit California customers to opt out of this type of sharing. You may request this information by contacting us at privacy@FiscalNote.com and indicate in the email subject line, "California Shine The Light Request." Please include your mailing address, state of residence and email address with your request.

Currently, our systems do not recognize browser-based "do-not-track" requests.
